This Privacy Policy explains how AmpedTechnologies Inc (“Amped”, “we” or “us”) collects, uses, and discloses information about you when you access or use our websites, mobile application, and other online products and services (collectively, the “Services”), and when you contact our customer service team, engage with us on social media, or otherwise interact with us.

We may change this Privacy Policy from time to time. If we make changes, we will notify you by revising the date at the top of the policy and, in some cases, we may provide you with additional notice (such as adding a statement to our website homepage or sending you a notification). We encourage you to review the Privacy Policy whenever you access the Services or otherwise interact with us to stay informed about our information practices and the choices available to you.

All individuals whose responsibilities include the processing of any information relating to an identified or identifiable natural person (“Personal Information”) on behalf of Amped are expected to protect that data by adherence to this Privacy Policy.

Information Collection

We collect several different types of information for various purposes to provide and improve our Service to you.

Information You Provide to Us

We collect information when you register for an account, participate in interactive features, fill out a form or a survey, participate in a contest or promotion, make a purchase, communicate with us via social media sites, request customer support, or otherwise communicate with us. The information you may provide includes your name, email, password, goals, previous experiences, street address, age, gender, city, payment method information, feedback and survey responses, and other information about you included within your messages to us. 

Some users also provide health-related information in connection with providing feedback or other messages to us, and we process that information consistent with the purpose for which it was provided. To make it easier for others to find you, we may also ask you to provide us with some additional information that will be publicly visible on our services, such as profile pictures, a name, your current or other useful identifying information.


Information We Get When You Use Our Services

When you use our services, we collect information about which of those services you’ve used and how you’ve used them. We might know, for instance, that you watched a particular video, or joined a live class or two. Here’s a fuller explanation of the types of information we collect when you use our services:

  • Usage Information. We collect information about your activity through our services. For example, we may collect information about how you interact with our services, how often you use our services, what’s the best time of usage is for you and so on.
  • Content Information. We collect profile picture, name, email, city, gender, age..
  • Device Information. We collect information from and about the devices you use. For example, we collect:
  • information about your hardware and software, such as the hardware model, operating system version, language, battery level, and time zone;
    • information about your wireless and mobile network connections, service provider, and signal strength.
    • Camera and Photos. You may use the camera to update your profile picture.
  • Location Information. We ask for a location to share where you are utilizing the Services.
  • Information Collected by Cookies and Other Technologies. Like most online services and mobile applications, we may use cookies and other technologies, such as web beacons, web storage, and unique advertising identifiers, to collect information about your activity, browser, and device. Most web browsers are set to accept cookies by default. If you prefer, you can usually remove or reject browser cookies through the settings on your browser or device. Keep in mind, though, that removing or rejecting cookies could affect the availability and functionality of our services such as keeping you logged in, having the correct time zone for class schedule and reminder notifications.
  • As a Service Member you will be able to connect activity trackers to your account. If you choose to synchronize an activity tracker with the Service, We will receive limited information about your activity to populate your account. Activity tracking devices can track a wide number of different aspects of your daily activities, including, among others, your daily steps and fitness activity, your heartbeat and sleep pattern. Depending on the brand and model of activity tracker you use, the data collected may vary. In general, companies selling activity tracking devices have specific privacy policies available, which outline what data the specific activity tracking device collects. We strongly suggest you review the right privacy policy to know what specific data points your activity tracking device collects about you.

Use of Information

We use the information we collect to:

  • Provide, maintain and improve our Services, and develop new products and service;
  • Process transactions and fulfill orders;
  • Send you transactional or relationship messages, such as receipts, account notifications, customer service responses, and other administrative messages;
  • Communicate with you about products, services, and events offered by Amped and others, request feedback, and send news, gifts or other information we think will be of interest to you;
  • Monitor and analyze trends, usage, and activities in connection with our Services; 
  • Detect, investigate and prevent fraudulent transactions and other illegal activities and protect the rights and property of Amped and others. 
  • Comply with the law, such as by processing transactional records for tax filings;
  • Personalize your online experience.
  • Facilitate contests, sweepstakes, and promotions and process and deliver entries and rewards.
  • Use information we’ve collected from cookies and other technology to enhance our services and your experience with them.
  • Enforce our Terms of Service and other usage policies.
  • To carry out our obligations arising from any agreements entered into between you and us.
  • To notify you about updates or changes to Product features and content. 
  • To understand your broad, non-specific geographic location to help us identify groups of users by general geographic market (such as zip code, state or country).
  • To account for applicable sales taxes based on zip codes provided to our payment processors for purchases made through the Website. 
  • To inform your Community about your registration and use of the Products as described under Corporate and Other Community Sharing.
  • To serve our advertisements to you through third party platforms, such as Facebook or Google, on other sites and apps or across your devices, to the extent that you have provided consent for such uses under applicable law.
  • To provide you with the SMS Service to the extent that you have provided consent for such practices under applicable law.
  • We may also ask you to complete surveys that we use for research purposes, although you do not have to respond to them.
  • If you are an existing customer, we will only contact you by electronic means (e-mail or in-Product communication) with information about products and services similar to those which were the subject of a previous sale to you, except if you opt-out to such communications.

Sharing of Information

We share information about you as follows and as otherwise described in this Privacy Policy:

  • With companies and contractors that perform services for us, including email service providers, payment processors, fraud prevention vendors and other service providers;
  • In response to a request for information if we believe disclosure is in accordance with, or required by, any applicable law or legal process, including lawful requests by public authorities to meet national security or law enforcement requirements;
  • If we believe your actions are inconsistent with our user agreements or policies, if we believe you have violated the law, or to protect the rights, property, and safety of Amped or others;
  • In connection with, or during negotiations of, any merger, sale of company assets, financing or acquisition of all or a portion of our business by another company;
  • Between and among Amped and our current and future parents, affiliates, subsidiaries, and other companies under common control and ownership; and
  • With your consent or at your direction. For instance, you may choose to share actions you take on our Services with third-party social media services via the integrated tools we provide via our Services.

Corporate and Other Community Sharing

There is interest by large consumer communities (companies, universities, hospitals, government agencies, etc.) (“Communities”) to introduce the Products to their employees, members, users, or customers. If you have registered to use the Products through a code or other registration credential furnished by a Community (a “Community Subscription”), the Community will have access to your email address, the date you registered to use the Products, and the date on which you last used the Products. The Community will also have access to your Community’s aggregated and anonymized general usage data. 

Your Community may also have access to your usage data on an individual basis, but only if you have provided appropriate consent under applicable law for such sharing. For example, many Communities are offering incentive programs based on members’ participation in health and wellness programs, and desire to better understand how their employees are using the Products.

Legal Basis for Processing Personal Data Under General Data Protection Regulation (GDPR)

If you are from the European Economic Area (EEA), Amped legal basis for collecting and using the personal information described in this Privacy Policy depends on the Personal Data we collect and the specific context in which we collect it.

Amped Technologies Inc may process your Personal Data because:

  • We need to perform a contract with you
  • You have given us permission to do so
  • The processing is in our legitimate interests and it’s not overridden by your rights
  • For payment processing purposes
  • To comply with the law

Retention of Data

The retention periods applied by Amped comply with applicable legislation in effect on the date hereof, namely:

  • For data relating to your account: such data will not be retained beyond your request that your account be deleted. 
  • For transactional data relating to your purchases: such data is kept for the entire period of the contractual relationship, then in accordance with legal obligations and applicable statute of limitation periods. Please note that this data does not include Payment Card information, which is processed by our third-party payment processors, and not Amped. 
  • For data collected based on your consent to receive our marketing communications: we will use such data until you withdraw consent or applicable law requires that such data is no longer used.
  • When your data is collected in the context of requests/queries: such data are kept for the period necessary to process and reply to such requests or queries.

Other data will be kept as long as necessary for the purposes pursued and in compliance with our legal obligations, including the applicable statute of limitations.

Transfer of Data

Your information, including Personal Data, may be transferred to — and maintained on — computers located outside of your state, province, country or other governmental jurisdiction where the data protection laws may differ than those from your jurisdiction.

If you are located outside United States and choose to provide information to us, please note that we transfer the data, including Personal Data, to United States and process it there.

Your consent to this Privacy Policy followed by your submission of such information represents your agreement to that transfer.

Amped will take all steps reasonably necessary to ensure that your data is treated securely and in accordance with this Privacy Policy and no transfer of your Personal Data will take place to an organization or a country unless there are adequate controls in place including the security of your data and other personal information.

Disclosure of Data

We may disclose your personal data to any member of our group, which means our subsidiaries, our ultimate holding company and its subsidiaries.

We may also disclose your personal data to third parties as follows:

  • In some circumstances, based on your specific requests, we may need to disclose your personal data to a third party so that it can provide a service you have requested from such party, or fulfill a request for data from such party. An example of this is the SMS Service.
  • In some circumstances, we may disclose the personal data that you have provided to Amped to a third party that offers and/or provides goods or services complementary to our own for the purpose of enhancing our users’ experiences by offering you integrated or complementary functionality, complementary services or bundled pricing options.
  • If Amped’s service providers (like hosting, IT maintenance, market analytics, and payment service providers) require this data to provide services to Amped. Amped requires each of its service providers to agree to maintain the confidentiality and security of your personal data.
  • In the event that we sell or buy any business or assets, in which case we may disclose your personal data to the prospective seller or buyer of such business or assets.
  • If Amped or substantially all of our assets are acquired by a third party, in which case personal data held by us about our customers will be one of the transferred assets.
  • If we are under a duty to disclose or share your personal data in order to comply with any legal obligation such as to comply with a subpoena, bankruptcy proceedings, similar legal process, or in order to enforce or apply our agreements with you; or to protect the rights, property, or safety of Headspace, our customers, or others. This includes exchanging data with other companies and organizations for the purposes of fraud protection and credit risk reduction.
  • With your Community, if your subscription is a Community Subscription, as described under Corporate and Other Community Sharing.

“Do Not Track” Signals Under California Online Privacy Protection Act (CalOPPA)

We do not support Do Not Track (“DNT”). Do Not Track is a preference you can set in your web browser to inform websites that you do not want to be tracked.

You can enable or disable Do Not Track by visiting the Preferences or Settings page of your web browser.

Your Data Protection Rights Under General Data Protection Regulation (GDPR)

If you are a resident of the European Economic Area (EEA), you have certain data protection rights. Amped aims to take reasonable steps to allow you to correct, amend, delete, or limit the use of your Personal Data.

If you wish to be informed what Personal Data we hold about you and if you want it to be removed from our systems, please contact us.

In certain circumstances, you have the following data protection rights:

The right to access, update or to delete the information we have on you.Whenever made possible, you can access, update or request deletion of your Personal Data directly within your account settings section. If you are unable to perform these actions yourself, please contact us to assist you.

The right of rectification.You have the right to have your information rectified if that information is inaccurate or incomplete.

The right to object.You have the right to object to our processing of your Personal Data.

The right of restriction.You have the right to request that we restrict the processing of your personal information.

The right to data portability.You have the right to be provided with a copy of the information we have on you in a structured, machine-readable and commonly used format.

The right to withdraw consent.You also have the right to withdraw your consent at any time where Amped Technologies Inc relied on your consent to process your personal information.

Please note that we may ask you to verify your identity before responding to such requests.

You have the right to complain to a Data Protection Authority about our collection and use of your Personal Data. For more information, please contact your local data protection authority in the European Economic Area (EEA).

Service Providers

We may employ third party companies and individuals to facilitate our Service (“Service Providers”), to provide the Service on our behalf, to perform Service-related services or to assist us in analyzing how our Service is used.

These third parties have access to your Personal Data only to perform these tasks on our behalf and are obligated not to disclose or use it for any other purpose.

Analytics

We may use third-party Service Providers to monitor and analyze the use of our Service.

Firebase

Firebase is analytics service provided by Google Inc.

Payments

We may provide paid products and/or services within the Service. In that case, we use third-party services for payment processing (e.g. payment processors).

We will not store or collect your payment card details. That information is provided directly to our third-party payment processors whose use of your personal information is governed by their Privacy Policy. These payment processors adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, Mastercard, American Express and Discover. PCI-DSS requirements help ensure the secure handling of payment information.

Our Service may contain links to other sites that are not operated by us. If you click on a third party link, you will be directed to that third party’s site. We strongly advise you to review the Privacy Policy of every site you visit.

We have no control over and assume no responsibility for the content, privacy policies or practices of any third party sites or services.
